free the grapes! pt 3: second circuit ruling

grapeman-w.jpgThe Second Circuit has upheld New York's ban on direct shipment of wine from out-of-state sources to NY residents, overturning the district court's 2002 ruling. Wholesalers are heralding the NY decision, but the issue itself is far from decided. The NY legislature may be considering a revision of the applicable state statutes, making NY a reciprocal shipping state and opening the market for consumers and producers alike.

I haven't yet read the opinion, but will post a link as soon as I'm able.

And who was worried that my comment topic wouldn't remain a hot topic?
